Terms of Service

These terms apply to all offers, orders and agreements of Filipucci B.V., trading under the name Filipucci Juweliers — regardless of whether the purchase takes place in the shop, via the website, via another (online) platform, by telephone or via WhatsApp. By placing an order or making a purchase, you accept these terms.

Definitions & Applicability

Filipucci — Filipucci B.V. (KVK 14629201, VAT NL804799015B01), trading under the name Filipucci Juweliers, established at Maastrichter Brugstraat 20, 6211 ET Maastricht.

Customer — any consumer or business that places an order or makes a purchase with Filipucci, through any channel whatsoever (shop, website, platform, telephone, WhatsApp).

Stock item — an item that is directly available for purchase and delivery.

Sourced Item / Special order — an item that is specifically ordered or sought for the customer from a brand or supplier, and is not delivered from stock.

These terms apply to every offer from and every agreement with Filipucci. Deviations are only valid if agreed in writing. For purchases in the shop, these terms apply insofar as they are applicable; some provisions (such as the right of withdrawal) apply exclusively to distance contracts.

Offers, Prices & Range

Filipucci sells watches, jewellery and related accessories, both new and pre-owned, via the shop, the website and other (online) platforms.

Margin scheme & VAT

The majority of the range consists of items sold under the margin scheme (VAT). For these items, no VAT is stated separately on the invoice, and VAT cannot be deducted by the buyer.

Which scheme applies to a specific item is stated on the invoice or product page.

Offers

All offers from Filipucci are without obligation. Filipucci reserves the right to change prices, in particular where legal regulations require this. Obvious errors or mistakes in the offer (for example an evident pricing error) do not bind Filipucci.

Order & Payment

Formation of the agreement

An agreement is formed at the moment Filipucci accepts the order, or — for purchases in the shop — at the moment of payment and delivery. Filipucci may refuse orders or attach conditions to delivery, for example in the event of doubt about identity or payment capacity.

For Sourced Items, an obligation to purchase applies as soon as Filipucci has ordered the item from the supplier or the brand. This is notified to the customer in advance — see the section Special Orders & Sourced Items.

Payment

All stated prices are in euros. Payment is made via the payment methods offered at the time of purchase (in the shop: debit card or bank transfer; online: the payment methods stated on the website or the relevant platform), or by advance payment via bank transfer to the account number stated on the invoice. In the case of advance payment, the payment date is the date the amount is credited to Filipucci's account.

If the payment term is exceeded, the customer is in default from the due date without further notice of default, and default interest of 1% per month (or part of a month) is due, plus €20 in administration costs after a reminder. In the event of outsourcing to a collection agency, collection costs of at least 15% of the outstanding amount are also due.

Delivery

Stated delivery times are indicative. Exceeding them does not give rise to any right to compensation, unless the delay is such that the customer cannot reasonably be required to maintain the agreement; in that case the agreement may be dissolved.

The risk of the items passes to the customer at the moment of delivery (in the case of shipment) or handover (in the case of collection in the shop).

Right of withdrawal (online orders only)

For online orders of stock items, the customer, if they are a consumer, has the right to withdraw from the agreement within 14 days of receipt without giving reasons.

The right of withdrawal does not apply to:

  • Purchases made in the physical shop — under Dutch law (Art. 6:230o of the Dutch Civil Code) no right of withdrawal applies to these, as they are not distance contracts. In-store purchases are final.
  • Sourced Items and special orders — see the section below.
  • Items that, following delivery, are clearly personalised for the customer (for example engraved jewellery).

Exercising the right

To exercise the right of withdrawal, the customer notifies Filipucci of this unambiguously within the term (by email or WhatsApp). The customer returns the item within 14 days of this notification, in the exact condition in which it was delivered — including original seals, stickers, packaging, warranty certificates, boxes and certificates.

Filipucci refunds the standard shipping costs of the original delivery paid by the customer within 14 days of receipt of the withdrawal notification, or after receipt of the returned item or proof of return, whichever is earlier. The costs of the return itself are borne by the customer.

Filipucci reserves the right to refuse a return or to reduce the amount to be refunded if the item is not returned in the condition in which it was delivered — for example in the case of missing seals, stickers, packaging, accessories or documentation, or in the case of visible damage, scratches or signs of use that were not present at delivery.

Special Orders & Sourced Items

This section applies to Sourced Items and all watches or jewellery that are specifically ordered or sought for the customer from a brand or supplier.

Before ordering from the supplier

If the customer wishes to cancel before Filipucci has ordered the item from the supplier, cancellation is possible free of charge.

After ordering from the supplier — no cancellation

Once Filipucci has ordered the item from the supplier or brand on the customer's behalf, the order is final. There is no right to cancellation, return or refund. By placing a special order, the customer confirms that they understand and accept this.

The 14-day right of withdrawal does not apply to Sourced Items and special orders, regardless of the channel through which they were placed.

Warranty — Watches

Filipucci provides its own warranty of 12 months from the date of purchase on all watches it sells, covering defects in the movement (mechanism). Part of the range is additionally covered by a manufacturer's warranty, as stated on the warranty certificate or the invoice. Manufacturer's warranties are administered directly by the manufacturer, not by Filipucci.

What is not covered

  • Normal wear — scratches, worn links, discoloured dials and other cosmetic changes due to regular use
  • Water damage
  • Damage from dropping or impact
  • Repair or maintenance by a third party not recognised by Filipucci or the brand — this voids the warranty entirely
  • Batteries, glass/crystal, straps and other parts subject to wear

Submitting a warranty claim

Report the defect within 14 days of discovery, within the warranty period, by email (info@filipucci.nl) or WhatsApp, stating your name, order number and a description of the defect. In the case of a valid claim, Filipucci repairs or replaces the relevant part, or provides a credit to the value thereof.

Warranty — Jewellery

On jewellery, Filipucci provides only an authenticity guarantee. There is no warranty against damage, breakage or wear: jewellery is delicate and damage arises through use beyond Filipucci's sphere of influence. This also applies to any boxes, certificates and other accessories supplied with it.

Repairs & Maintenance

Repairs and maintenance are outsourced by Filipucci to external, brand-recognised service centres. In this respect, Filipucci acts as an intermediary.

  • Stated turnaround times are indicative and depend on the external service centre
  • Costs for repair/maintenance are communicated to the customer in advance where possible, and only charged after approval
  • Filipucci is not liable for delay, loss or damage arising at the external service centre, except in the case of intent or gross negligence on the part of Filipucci itself in the delivery of the item
  • Repairs are covered by the warranty as provided by the relevant service centre

Uncollected repairs & orders

If a repaired or specially ordered item is not collected within 3 months after three written reminders (the last by registered letter), Filipucci is entitled to sell the item and to recover its costs from the proceeds. Any remainder may be claimed for up to 3 months after the sale.

Complaints

The customer inspects the item upon delivery and reports any defects to Filipucci as soon as possible, and in any event within a reasonable time, in writing and with reasons. If it has been demonstrated that an item does not conform to the agreement, Filipucci has the choice between repair, replacement or refund of the invoice value.

Ownership, Liability & Force Majeure

Retention of title

Delivered items remain the property of Filipucci until the customer has fully met their payment obligations. The risk, however, passes at the moment of delivery.

Liability

Filipucci is not liable for misunderstandings, delays or errors in communication via the internet or other means of communication, except in the case of intent or gross negligence. Filipucci's liability is in all cases limited to the invoice value of the item concerned, except in the case of intent or gross negligence and except for mandatory consumer protection.

Force majeure

Filipucci is not obliged to perform if it is prevented from doing so by force majeure — any circumstance beyond its will and control that means performance cannot reasonably be required of it.

Filipucci processes personal data in accordance with its privacy statement, alongside on this page.

For certain transactions, Filipucci is legally required to carry out an identity check. For this, Filipucci uses Didit.

Applicable Law & Final Provisions

All agreements with Filipucci are governed exclusively by Dutch law. All disputes are submitted exclusively to the competent court of the District Court of Limburg, Maastricht location.

Filipucci may use third parties in the performance of the agreement. If any provision of these terms proves to be void or voidable, the remaining provisions remain in full force and the void provision is replaced by a provision that corresponds as closely as possible to the purpose of the original provision.

Amendments

Filipucci may amend these terms at any time. Amendments are announced by updating the date at the top of this page.
